  1. Re: Sheppard's Past

Looks like Bryant's PR people are doing a good job digging up dirt... or maybe reporters are just eager for scandal here.

One thing really coming out during this tragedy is that people are talking. Online, it is bringing out sound opinions and frustrations, it is also bringing out trolls and those who can't seem to express themselves rationally. But the Internet is a sounding board, no matter if you agree with the noise or not.

I'm hoping to see more people are now at least aware of cyclists on my commute. Since we're so few in numbers north of Eglinton, drivers rarely take their eyes off their phones long enough to see me. Could this incident at least make cyclists visible to these blind eyes? I'm hoping so.

  2. It might be Bryant's people digging up dirt, but then again it doesn't seem like Sheppard was living under the radar so I can't imagine it's a hard job. In any case I don't really care how much dirt they dig up on Sheppard; he's ultimately the one that got the death sentence simply for being moderately obnoxious. At worst Sheppard should have spent the night sobering up in a local police station after the altercation. Instead, he was run over by a political elite, and it was kinda sorta not an accident. I mean all Bryant really wanted to do seemingly was severely injure him and then drive off....

A friend of mine keeps saying that this whole story actually isn't about cars versus bikes at all and I think he's right. We focus on it because it's the worst possible escalation between what should otherwise be rational adults in traffic, but in the end, it's about two hotheads jumping right off the deep end. And let's face it, these two guys were both extremely strong personalities.

One day I may get creamed by a Lincoln Navigator let's say, but it won't be because I held on to the damn thing while it was speeding down the street into oncoming traffic. More likely it'll be because of an accident, either my fault or the driver's.

Amazingly the best, most compassionate (to both parties) coverage is coming from the G&M. When did I enter a parallel universe? I always lumped the G&M in with The National Post.

  3. I just posted Photos and Video from last night's Memorial over in the Memorial topic.

    • Cyclist may have grabbed Bryant, wheel: police

Toronto police are investigating whether a cyclist killed in an altercation with a car driven by former Ontario attorney general Michael Bryant grabbed the driver or the steering wheel.

Police have seized a number of video surveillance tapes from the stretch of Bloor Street where the confrontation occurred and are examining them frame-by-frame to confirm the accuracy of witness accounts that have suggested the cyclist may have been trying to get Bryant into a headlock and that the two may have been wrestling for control of the wheel.

"We're looking at avenues from the point of reaching into the vehicle pointing at the person, reaching in to maybe unlock the door, hanging on, standing there. We're looking at all those angles," Toronto Const. Hugh Smith told CBC News.

  4. Contrary to the Toronto police claim Bryant was treated like anyone else, in reality he was handled with great deference according to a CBC Toronto Radio interview broadcast today, most notably, he was released by the police on his own recognizance without the usual bail hearing in front of a magistrate and he wore a fresh suit and tie for his press conference immediately upon release complete with the reassurance of an officer standing behind him. And what enquiry has been made of his consumption of alcohol?

In any event, as much deference is unavoidably given to a politicol who's of the legal elite, shouldn't his behaviour similarly be held to a higher standard?

Okay, so maybe the courier was a street ruffian spoiling for a fight, a n'er-do-well, a drunkard addicted to street drugs and a wife beater. The simple point is it shouldn't matter if he had two heads and a tail. Clearly the onus was on the driver having every advantage Canadian life can afford to control his road rage to the extent the cyclist wasn't killed, a cyclist who had a host of personal disadvanages, not the least of which being the weight and power of his vehicle.

From everything I'm read, Bryant's behaviour just doesn't add up! A cool headed lawyer, an experienced member of cabinet with a political future - he has too much to lose! So I can't help but wonder - just how much booze did Bryant consume during his anniversary wedding celebration? Has anyone checked with the wine steward? While it's okay, easy to besmerch a bike courier, would this line of enquiry as to Bryant's state of inebriation be out of bounds?

  5. I feel compelled to add to this discussion.

The entire story, our shock at the events, the crux of the criminal charges ... all rest on one aspect.
Why was Bryant's foot continually on that accelerator?

The defence needs to come up with a plausible explanation.
    Nothing else matters.

I would look seriously and closely at the news reports.

For example, if there was a "collision", then was Bryant leaving the scene of an accident?
At this point, the evidence suggests that Bryant showed a total disregard for another person's life, and was reckless about the obvious consequences.

  6. If Bryant wasn't charged with what he was charged with, I'd be wondering if Sheppard had him in a head-lock, for example. That's the only way I can see Bryant mashing the gas without regard to his or Sheppard's well being, because he might not have even known he was on the gas if he was fighting for air.

    That's a big IF though, there's apparently lots of surveillance video.. And right out of the gate, he was charged with "Criminal Negligence Cause Death" and "Dangerous Operation of a Motor Vehicle Cause Death". I am not nearly a lawyer but the Star spells them out here;

    http://www.thestar.com/news/gta/article/689429

It doesn't sound like the officers that made the arrest believe that control of Bryant's vehicle was yanked away from him by Sheppard.

Time will tell though of course. I just had my interest rekindled slightly as I passed the spot on my way home (in a car). Really, from what the map shows where the incident took place, when you're looking at it on the ground, I'm still not even entirely sure how they got into an altercation in the first place.

  7. Not sure the timing on this one but it looks pretty damning to me.

Full disclosure warrants I mention that I know nothing about the source or authenticity of the video. Still, if this is what started the whole thing off it makes a bit more sense.

  8. Erk; I think we can scratch my scenario off that list then. Pretty hard to have Bryant in a headlock when you're near the hood.

  10. The video and witness accounts are why Navigator LTD focusses on media outlets so strongly and why his counsel seeks to undermine the police investigation by holding a parallel investigation utilizing persons in their pay.

There is simply nothing they can do about Crown evidence except try and convince the public that the victim was the aggressor and that the police are inept. It is a dreadful shame that a man who claims to have championed Law and is well versed in same would choose to put himself above it so publicly.

This behaviour after the fact of the incident reflects very poorly on all other government elected officials or appointees.

Please don't accept the messages Navigator and Bryant are paying the media to bring you. They seek to usurp the natural course of our system of law by exploiting bias and ignorance. Given his past this is a terrible sin on behalf of Michael Bryant.

    INDEED!

I watched that video several times and from I saw: start of video shows Darcy riding around the left side of the Bryant's vehicle and then stopping ahead of Bryant.

6 - 7 seconds in; Bryant thrusts the car forward and into the back wheel of Darcy's bike.

At 11 seconds in; Bryant, who is now in contact with Darcy's bike (or at the point of impact) then hammers the gas pedal and tears off. That is 4 seconds from impact to attempting to leave the scene.

This time frame would give Darcy only 4 seconds to assess what just happened, hop off of his bike, check for damage, walk around to the driver's side, engage in an argument with Bryant, allegedly place Bryant in a headlock/grab steering wheel/seat/head rest or whatever silly notion that has been purported to have happened. I highly doubt any of those things did occur as there simply was not enough time to physically do all of that in under 4 fucking seconds (excuse my 'french')!

You can't distinguish my theory/analysis of the aftermath in the video, which is: Darcy may have hopped off his bike, possibly ran to the driver's side of Bryant's car, where Bryant, seeing a very understandably pissed-off Darcy approaching, experienced a 'holy shit' moment, panicked in those short few seconds after hitting Darcy, and realizing how stupid his actions were, proceeded to flee. Darcy grabbed on to the car to try and stop him or thought that by doing so, Bryant would have enough sense to stop. And Bryant didn't stop until Darcy fell off like a ragdoll after being pummelled into stationery objects by Bryant's car with Bryant at the wheel.

And because I couldn't really see Darcy running around to the side of the car in the video, my initial thought was that Darcy never made it off of the bike and Bryant hammered the gas which tossed Darcy onto the hood of the car. Yet shots of Darcy's bike, after the fact, don't really support that it was run over by the car, when Bryant fled, as it looked quite intact.

Another video I have seen shows why the bike wasn't run over. Bryant did hammer the gas which did toss Darcy onto the hood of the car. Bryant then immediately stopped. Backed slightly and drove around the fallen rider and bike to get away. Darcy gave chase to the car as it had to pass him to get away. Darcy did attach himself to the car to try to prevent Bryant from fleeing. Of course, Bryant didn't stop.

That video is here and the onto-the-hood-and-backing portion is 18 seconds in.

    http://tinyurl.com/nprxfd

Nonetheless, my mind is made up. It was made up as a result from the witness accounts from last Monday night/Tuesday morning. My thoughts have now been solidified by viewing this video. Bryant is a murderer and is a despicable human being. Bryant instigated this action. Bryant was the agitator. Bryant is not innocent!

    My final analysis and conclusion:

There was no verbal exchange or argument or anything of the sort. This incident happened in seconds! For some reason, Bryant was impatient that night, taunted and threatened Darcy, who then used his car to first hit Darcy's rear wheel and then, 4 seconds later, accelerated greatly, tossing Darcy onto the hood and plowing/pushing Darcy's bike - not running it over. Travelling only a few feet, Bryant then braked hard, sliding Darcy off of the hood which landed him next to his bike. Bryant backed up slightly to clear the fallen Darcy - now getting up - and proceeded to drive off. As the car wasn't yet going very fast, Darcy slammed his backpack on the hood to get Bryant to stop and in the process attached himself to the car to get Bryant to do just that. Once again, Bryant didn't stop. The maniac panicked and then tried to rid himself of the only living witness that could bury him. He succeeded.

Is it any wonder that Bryant's PR frm, Navigator Ltd. is doing it's level best at destroying the character of Darcy, while working very hard at garnering public support and sympathy for Bryant? It's what these people do for those who can afford it and are GUILTY!

  12. Spinning the first week of Michael Bryant’s new life: It helps to have friends in PR (Sept. 5, 2009)

    snippets:

"It’s a reasonable bet you, too, have an opinion. But is it, you might ask, your own? Definitely not, says a veteran Toronto criminal lawyer, loath to have his name published. “Look, the headline on this story should be: ‘Navigator, changing your perceptions without you even knowing it.’”

He refers, of course, to Navigator Limited, the smooth public relations firm hired by Bryant (when exactly is unclear) to massage the message. He’s said to be close to Navigator chair Jaime Watt, touted for knowing everybody in Canadian power circles. Senior partner Robin Sears most recently was spokesperson for Brian Mulroney during the parliamentary investigation into his dealings with deported German arms dealer Karlheinz Schreiber.

Navigator isn’t shy on its website: “Clients have praised us for our ability to take an issue that has been looked at, sometimes for years, and radically shift perspective to reveal new insights. These fresh insights are what our strategies are built on.”

Experienced legal and political hands see Navigator’s fingerprints all over public opinion. Shortly after a noon strategy meeting yesterday that apparently drew together Navigator staffers and Bryant’s criminal defence lawyer, highly regarded Marie Henein, Sears acknowledged a reporter’s remark that things seemed to be going well for them.

“I’m glad you agree,” he said. “We’re working hard to ensure that it does. A big part of that is us staying out of the story.”"

    ----

"There was no reason to ask Bryant for a breathalyzer(?!), says Burrows, and according to a Toronto Star story, there was no alcohol at their dinner."

Well that story was 2 days AFTER the fact! The Toronto Star isn't the prevailing decider here. The police should have had him blow anyway.

"Police allowed Abramovitch to leave the scene without giving a statement – again, usual practice for someone easily located."

Who was in the car that night and could easily flee. 'Easily located' translated merely means that you know where they live. They can still flee. The two of them should have been arrested. Bryant should have been charged with murder and his wife a lesser charge as an accomplice who did nothing to stop this incident.

"Bryant was put in the back of a police cruiser before being taken to the traffic services station in the Liberty Village area. He didn’t give a statement."

    ----

"Will McDowell, a former colleague and another on Bryant’s meaty list of loyalists, cautions against rushing to judgment so early in the case. “Michael will get through this,” he says. “He has so much to contribute. He will be a presence in this city and in Canadian politics for a long time to come.”"

    Sickening.

  15. Those bike-mounted digital video cameras are sounding pretty good these days. Maybe one on the handlebars and another on the rear rack. Or maybe the handlebar one should go on the helmet. The tech is getting cheaper - at some point it might be as much a good option as other safety equipment.

"This account is maintained by Michael Bryant’s team. The purpose of this account is to quickly correct inaccuracies as they appear with factual responses."

    Here's the associated Blog - http://bryantfacts.wordpress.com/

  18. Interesting. I think they'd get more credibility, though, if they did more than deny but actually cite sources. Between that and their rather poorly constructed site I suspect that Bryant's so-called team has little to do with it. I think a large PR firm could do much better than that.

  19. Story is expanding internationally:

    • NPR: In Toronto, Bike-Car Road Rage Escalates
      (audio file available)

On Spadina Avenue in Toronto's Chinatown district, the bike lanes are only a couple of feet wide. The bikes weave in and out of car traffic and dart across streetcar tracks. Noah Budnic, who heads the North American Alliance for Biking and Walking, says conditions like that cause stress that can lead to confrontations.

"This change going on on the streets is happening on the fly," Budnic says. "They're learning how to behave differently and drive and bike on streets that are still designed for cars. So there's a lot of tension because people are just making it up as they go along."

Road rage expert David Weisenthal, a psychologist at Toronto's York University, says it's that sense of unpredictability, combined with a desire for revenge, that leads to conflicts.

"We know we will never see the other drivers again who are in front of us, in back of us, alongside of us," Weisenthal says. "We also have a sense of anonymity so that we feel freer to act in what may very often be a nasty manner."

Weisenthal says cities have to do a lot more to separate bikes and cars. In the meantime, some people in Toronto are doing what they can to try to keep the two apart.

  20. I like how Michael Bryant's PR people characterize everything that doesn't support them as one sided. I guess the PR firm is going to be open, fair and objective. I like the assertion that he stopped and didn't leave the scene, well actually he left the scene of an accident not once but twice. They don't say anything about his original fleeing the scene of the accident that precipitated the incident in the first place.

Unfortunately the story will be one sided, mostly Mr. Bryant's side, as he killed the only other person that could tell the other side.

  21. Eyewitness accounts:

  22. One has to realize Michael Bryant believes he is above the law, just as the cops have found about 10 witnesses that saw this man killing this poor cyclist, right now there are cops out there looking for a 100 witnesses that did not see it. He has judges on his payroll that have said publicly "The law does not have to be fair"

People do not expect justice,it wont happen, Mçguinty will see to that.

  23. steyrshek it is not about a one-sided story, more about the the fact that Bryant who appears to be as guilty.

Bryant will probably get a $5 fine for driving on the pavement. It is also noticeable that the cops did not give Bryant a blood test ??????

  24. [Rosks304 - we appreciate your opinions about Michael Bryant, but this isn't the place to make statements about him being a murderer (feel free if he is convicted as such) or about him torturing or killing pets. let's keep the discussion within reason and the law and some semblance of fair play, even though it is indeed hard not to be upset about what happened that night.

you know, there are times, many these days, when you just have to say to yourself "thank God for the internet"

thank God that public discourse is not left in the hands of a few ...

  28. Michael Bryant can't drive, so he's cycling:

    • Lawyers to make court appearance in Bryant case

Lawyers in the Michael Bryant case are expected to make a brief court appearance today, their first since the former attorney-general was charged in connection with the death of a cyclist.

Dan Robertson of Navigator Limited, the public-relations firm hired by Mr. Bryant shortly after the incident, said that Mr. Bryant would not be attending.

The accused faces charges of dangerous driving and criminal negligence causing the death of Darcy Allan Sheppard, 33, a bicycle courier who collided with Mr. Bryant's Saab convertible on Aug. 31.

Mr. Bryant was charged and released the next day without a bail hearing and was told to surrender his passport and refrain from driving.

He has since been spotted cycling.

  29. TORONTO — Criminal charges against former Ontario attorney general Michael Bryant will be heard before a Toronto court on Nov. 16.

Bryant was not in court today for a routine proceeding in which the case was put over to the new date.

  30. I guess this case is also a hot topic in legal circles:

    • How to defend Michael Bryant

Like the famous Abraham Zapruder film of President John Kennedy's 1963 assassination, the grainy video is at once ominous and teasing. It gives a hint of what happened in the seconds before Mr. Sheppard was allegedly crushed against a mailbox and Mr. Bryant commenced his forced march through the justice system that he once ran.

With the Crown and defence quietly preparing for battle, speculating about the upcoming trial – which could go ahead in late 2010 – has become a popular parlour game amongst seasoned criminal lawyers.

      ...

Most important, fingerprint experts will try to pinpoint every place Mr. Sheppard touched on the car. Should it turn out that he gripped the steering wheel – whether in panic or in fury – the defence stands a strong chance of persuading a jury that Mr. Sheppard inadvertently steered himself to his own death.

“The closer you get prints on the inside of the car, the more the pendulum of self-defence swings in Michael Bryant's favour,” Mr. Skurka said.

Before a trial can take place at all, however, Mr. Peck must first assess whether there is a “reasonable prospect” of convicting Mr. Bryant based on the evidence. Since Mr. Bryant can testify without fear of contradiction from Mr. Sheppard, Mr. Peck may well see little chance of a conviction.

  31. The case has been delayed until December 7, 20009:

    1. Criminal case against former Ontario AG put off

TORONTO — A criminal court case involving former Ontario attorney general Michael Bryant has been put off until Dec 7.

The former political star, who has yet to appear in court, was represented by his lawyer, Marie Henein.

"We are anxious to have this matter move forward," she told the Toronto judge.

Henein said her client's case hasn't moved ahead because she is still waiting for disclosure documents from the Crown.

Mark Sandler, who represented the Crown in court, told the judge that both sides agree that the case should proceed as quickly as possible.

Both sides are expected to attend a closed door, case management session with Justice Paul Bentley on Nov. 30, which both sides described as a routine step.

Henein said she hopes to have the disclosure documents by then.

Bryant faces charges of criminal negligence causing death and dangerous driving causing death in a collision involving a cyclist in August.

Police say bike courier Darcy Allan Sheppard died after grabbing onto a car in Toronto following an altercation with the driver.

Since Bryant once appointed judges and oversaw Crown prosecutors, Vancouver lawyer Richard Peck has been brought in to prosecute the case.

An out-of-province judge is expected to preside over the trial once it begins.
